A new HUD rule threatens regulations protecting housing access.

On April 28, HUD published a Notice of Proposed Rulemaking, “Equal Access to Housing in HUD Programs Revisions” seeking to remove regulatory provisions that protect access to HUD shelter and housing programs regardless of sexual orientation or gender identity.

If finalized, the rule would remove protections for LGBTQ+ people trying to access HUD programs, invite invasive questioning about a person’s sex assigned at birth, and attempt to override state and local anti-discrimination laws.

Advocates 4 Trans Equality launched the Housing with Dignity Campaign and developed a toolkit to submit a comment.

The comment period for the NPRM is open until June 29,2026.
